Mutation of Land in Rajasthan

Mutation in Rajasthan, also termed ‘Dakhil Kharij,’ is recording the change or transfer in the title of ownership after the property is transferred or sold. Once the mutation of property in Rajasthan is done, the same is recorded in the land revenue department, which eventually helps the authorities fixate on the tax liability.

The process of mutation in Rajasthan is not a one-time affair. It should ideally be done every 6 months to ensure that no fraudulent transactions concerning the property are being given effect.

Mutation is required every time a change/transfer of ownership is given effect. The same could be done in the following ways:

  1. Sale/purchase of property – In such a case, the documents that would be required are a copy of the registered sale deed, application for mutation with the court fee stamp, latest property tax clearance documents, indemnity bond on stamp paper, etc.
  2. Inheritance of property (intestate succession or through a will) – A copy of the death certificate, documents establishing the relationship between the deceased and the claimant, a copy of the will, property tax clearance documents, etc, would suffice.
  3. Power of attorney – In the concerned case, the mutation documents would be a copy of the power of attorney papers, affidavit, indemnity on stamp paper, property tax clearance documents, etc. The value of stamp paper in the instances above would vary.

Types of Mutation in Rajasthan

Mutation is of two types:

Mutation of Agricultural land

In the case of agricultural lands, unlike non-agricultural lands, it has a bearing on the title of ownership. The transfer of ownership will be regarded as legal once and if the mutation process in Rajasthan is duly completed and the same is recorded in the revenue records. If the Government acquires the concerned piece of land, compensation is given to only those whose names are registered in the records.

Mutation of Non-agricultural land 

In such a case, the non-mutation of land will not have a bearing on the property’s title. It will affect the owner’s liability to pay municipal tax and may even tamper with their water supply and electricity connection. Examples of non-agricultural lands are independent houses, flats, residential complexes, etc.

Mutation Process in Rajasthan

The Mutation process starts with submitting the application for mutation with the area’s Tehsildar, along with a non-judicial stamp paper of the required value. The documents above, too, need to be submitted as per the case. Once this is done, a proclamation asking for objections to the proposed mutation is issued, stipulating the last date for such objections.

The parties’ statements are also noted and matched with the submitted documents’ contents to look for discrepancies. If no discrepancy or objection is found, the proposed mutation is passed.

If any objection is received or a discrepancy is found, the matter is referred to the area’s Revenue Assistant, and the particulars of the objections are duly noted. If the concerned parties are unsatisfied with the order, an appeal is filed before the Additional Collector (the concerned Deputy Commissioner) within 30 days of the concerned order. This is a generic procedure, as the intricacies of the process and documents vary from one state to another.

Online Khata Mutation Process on Apna Khata Rajasthan

Users can easily apply for the mutation on the Apna Khata Rajasthan portal by following the below-mentioned steps:

  • Go to the official Apna Khata land records website online.
  • Click ‘Namantaran Ke Liye Apply Karein’ on the homepage or apply for mutation. A new page opens. 
  • Enter the details such as Applicant’s name, father’s name, Address Address, District, Village, etc. 
  • Fill in the details and click the Submit button.

Citizens can submit applications for the mutation online. Once the application is submitted, the department will check the application, and if found correct in all respects, the mutation will be done. You can also check the mutation status on the Apna Khata land records portal online.

Jamabandi copy is available on Apna Khata Rajasthan under the agricultural land records of Rajasthan. It must be highlighted that the information provided is for general information only, and some of its records are not updated immediately, so it cannot be used as a certified/authorized copy in any court or office. The users must apply for a certified authorized copy at the designated kiosk.

Steps to Apply for Mutation of Land in Rajasthan via UIT Online

The step-by-step procedure is as follows:

  • To apply for mutation online, log in to Urban Improvement Trust (UIT), Udaipur: https://urban.rajasthan.gov.in/
  • Click on e-Services and select Online 90A from the drop-down.
  • Click on Apply Now, log in using the credentials, or click on Registration. 
  • Click on the application option, and from the drop-down, select revenue department. 
  • Fill in all the required information and upload a photo by entering the below details.
  • Upload address proof and application form. Submit the document by selecting the Zilla.
  • The mutation number and fee structure will appear on the screen. Pay the fee and apply.
  • Check the application status on the UIT portal, and Patwari will process the application. The document with khata changes will appear on Jamabandi. 

How to Check Mutation Property?

Below are the steps to follow to check the details of the mutation of property in Rajasthan:

  • Visit the Apna Khata Rajasthan website by clicking on the link: 
  • https://apnakhata.rajasthan.gov.in/Owner_wise/DistrictMap.aspx. Click on ‘E-Friend Login,’ provide your username and password, and enter the captcha in the box available.
  • From the ‘select district’ drop-down menu, select the district where you wish to check the mutation of the concerned property. You can directly click on the district shown on the map.
  • You will be directed to a new page. Choose the ‘Tehsil’. Select the cadastral year.
  • Under the ‘Village Patwar Circle,’ select the one for which the mutation property you wish to check.
  • Provide the name and address of the applicant, the city in which the applicant resides, and the pin code.
  • Under ‘Option to issue copy,’ choose ‘account,’ ‘measles,’ ‘by the name,’ ‘From USN,’ or ‘From GRN.’
  • Enter the concerned number in the box based on your chosen option. For example, provide the USN number in the box if you chose’ From USN.’
  • You will find the details of the Rajasthan land mutation status.

Property Muatation vs. Registration

Even though they appear to be similar processes, property mutation and registration differ.

Property registration is the process through which property gets transferred in the buyer’s name after the payment of stamp duty and registration charges. At the same time, the property mutation process takes place after this formality, typically after a year or so.

While a property is registered by executing the sale deed after the buyer and the seller reach a consensus, property mutation occurs after the transaction. The property mutation process is basically a buyer’s responsibility, wherein the buyer gets his newly owned asset updated in his name in the local revenue office.

Documents Required for Mutation of Property

Documents required to complete the mutation process vary from state to state. However, a buyer must submit the following:

  • Correctly filled out the property mutation application form
  • Copy of the sale/title deed
  • Affidavit on stamp papers
  • Indemnity bond
  • Copy of  Aadhaar Card
  • Property tax receipts
  • Copy of will succession certificate or death certificate of the owner (if applicable)

The new owner gets the revenue records in his name by mutating the property. The mutated land details are updated in Rajasthan revenue records (Jamabandi) and mutation register (P-21) maintained by the State government.
